These Terms of Service ("Terms") govern your use of the Foxtone Media website and any services provided by Foxtone Media LLC ("Foxtone," "we," "us," or "our"), located at 2715 81st, Lubbock, TX 79423. By accessing our website or engaging our services, you agree to these Terms.

1. Services

Foxtone Media provides the following categories of services:

• Marketing retainers — monthly content creation, SEO management, digital advertising, email marketing, and lead generation packages.
• Production services — video production, brand photography, music videos, and social media content.
• Studio rental — hourly and session-based rental of our Podcast Studio, Sound Stage, and Studio A recording room.
• À la carte services — individual marketing and production services available outside of retainer packages.

Specific deliverables, pricing, timelines, and terms for any engagement are governed by a separate written agreement or proposal provided to the client. In the event of a conflict, the signed proposal or agreement takes precedence over these Terms.

2. Website Use

You agree to use this website only for lawful purposes and in a manner that does not:

• Infringe on the rights of others.
• Transmit spam, malware, or other harmful code.
• Attempt to gain unauthorized access to any portion of the site or its systems.
• Misrepresent your identity or affiliation with any person or entity.

3. Studio Rental Terms

• Booking confirmation — a studio rental is not confirmed until you receive written confirmation from Foxtone Media.
• Cancellation — cancellations made less than 48 hours before the scheduled session may be subject to a cancellation fee equal to 50% of the booked session rate.
• Conduct — renters are responsible for the conduct of all guests during their session. Damage to equipment or the facility may result in additional charges.
• No smoking, no alcohol — smoking and alcohol are not permitted in the studios.
• Equipment — renters may not remove equipment from the premises. Any technical issues should be reported to staff immediately.

4. Retainer & Service Agreements

• Payment — retainer fees are due on the first of each month unless otherwise specified in your agreement. Late payments may result in a pause of services.
• Cancellation — retainer agreements require 30 days' written notice to cancel, unless a different notice period is specified in your agreement.
• Deliverables — timelines and deliverable counts are specified per agreement. Foxtone Media is not liable for delays caused by client failure to provide required materials, approvals, or feedback.
• Revisions — revision rounds are defined in each project agreement. Work outside the agreed scope may be billed separately.

5. Intellectual Property

Upon receipt of full payment, clients receive a license to use the deliverables produced by Foxtone Media for the purposes specified in the project agreement. Foxtone Media retains the right to display completed work in its portfolio, on social media, and in marketing materials, unless the client requests otherwise in writing.

All website content, branding, photography, and original materials produced by Foxtone Media remain the intellectual property of Foxtone Media until full payment is received.

6. Disclaimer of Warranties

This website and our services are provided "as is" without warranties of any kind, express or implied. Foxtone Media does not guarantee specific results from marketing services, including but not limited to search engine rankings, advertising performance, follower growth, or revenue outcomes.

7. Limitation of Liability

To the fullest extent permitted by law, Foxtone Media's total liability to you for any claim arising from our services or this website shall not exceed the total amount paid by you to Foxtone Media in the three months preceding the claim. Foxtone Media is not liable for indirect, incidental, or consequential damages of any kind.

8. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising under these Terms shall be resolved in the courts of Lubbock County, Texas.

9. Changes to These Terms

We may update these Terms at any time. Updates take effect upon posting to this page with a revised effective date. Continued use of our services after changes constitutes acceptance.
